These terms apply to your use of this website and to services you buy from Upscalr Marketing ("we", "us"). A signed proposal or service agreement with you takes priority over these terms where they differ.
Our services
We provide Meta (Facebook and Instagram) advertising, lead generation, website design and local search engine optimization for businesses. The scope, price and length of each engagement are set out in your proposal.
Pay-per-lead
- A lead is a real person in your service area, with a working phone number, asking for a service you offer. Every lead is sent only to you.
- Leads are billed weekly at the per-lead price in your proposal, up to the weekly cap you agree to.
- If a lead does not meet this definition, tell us within 48 hours of delivery and we will credit it in full.
Websites and SEO
Website projects are billed as stated in your proposal. Monthly SEO and care plans renew each month until either side cancels with written notice before the next billing date.
No guaranteed results
We work hard to deliver leads and rankings, but results depend on things we do not control, including ad platforms, search engines, your market, pricing and how quickly you follow up. Statistics and estimates on this website are for illustration and are not a promise of results.
Your responsibilities
You agree to give us accurate information, respond to leads promptly, follow the law in how you contact leads, and make sure the content you give us does not infringe anyone's rights. Ads must follow Meta's and Google's policies, including special rules for housing, credit and health-related ads.
Payment
Invoices are due on receipt unless your proposal says otherwise. We may pause work on accounts that are past due.
Ownership
Once paid in full, you own the website content and ad creative we make for you. Ad accounts and pages should be set up in your business's name. We keep ownership of our own tools, templates and know-how.
Limits on liability
To the extent the law allows, we are not liable for indirect or lost-profit damages, and our total liability is limited to the fees you paid us in the three months before the claim.
Governing law
These terms are governed by the laws of the State of Oklahoma. Disputes will be handled in the state or federal courts located in Oklahoma County, Oklahoma.
